Whether out of his pocket or whether he gets on the horn and gets those in charge to get it out to you, he has liability.  When hiring you he was acting as an agent for the project. If he refuses, file a small claims action against him and let the judge explain to him that HE has to pay you and if he doesn’t like it, HE can then sue the Uni for the $$$ back. So now, i’ve been waiting for my cheque to arrive for a while, a month or so…….and still nothing, so today i called up the MD who told me about the $100, and said all of a sudden thats not he’s department, he’s no longer associated with MUMCO (the name of the theatre company) since he was just the MD, so he told me to call some person who was part of the manegement of MUMCO. So i gave her a call and apparently there’s a problem. I think, as i understand it, there was another bassist, a ‘professional’ was going to play and he  was supposed to be payed $100 or something along those lines. So she tells me that no-one was prepared to pay me the money the MD told me i was going to be payed. So right now i’m paidless, if thats a word….. What would you do? Roger,  Here is what I would do: Talk to whoever is now in charge of the money. Explain the situation and what you need.Get names and phone #’s and keep a record of who you talked to. State your need to get paid and reasons why as calmly and assertively as you can; the more you come accross as"businesslike", the better the chances of getting what you want. Don’t get angry or threatening. Set a specific time to get your money and tell them you will  pick it up – even if it is inconvenent for you to do so. Don’t let them give you the "check’s in the mail" speech. It is a lot harder for them to turn you down in person. It doesn’t matter if the other guy is a "professional". They offered you the job first and offered to pay you, so you are one as well and desreve to be treated as such. Be persistent; the longer you let it wait, the less chance you have of getting paid. And $100 gig is $100! String enough of ‘em together, and you can make a living. I had a similar situation a couple of months ago. The local symphony called me for a gig. I told them I would that definitely do it, but that I just needed to call a sub for my regular gig and would call them back to confirm in 10 minutes. When I called them back to tell them everything was cool, they said that one of their regular guys called right after I talked to them, and they gave him the job. I was REALLY pissed,  but I kept my cool and calmly explained in no uncertain terms that I had given up a prevoius engagement to help them out,  that I was now losing money on the deal, and that I expected to be paid.  Fortunately,  they offered to pay me before it got ugly, and cut me a check the next day, which I picked up at their offices. — John

yea i’m not too sure about the whole legal thingy, not that i’m worried about the legal system, i’ll all supportive of it!, but its probably not worth the bother. the other thing is is that this happens to be a not so well off theatre company. Since its a Uni company, all the particpants are voluntary and don’t get paid, but i heard that they needed a bass player, so came forth – you see, i’m no way affiliated with the uni, i’m a total outsider, so as a proffesional bass player (not that i regard miself as a por :-) just as in playing this job for the $$!) So the company probably does’t HAVE $100 to pay me with!!!!!! They’d probably have to take it out of thier own pockets!!!! Also the $100 was i think, a bit too casually mentioned. I just heard about it, after the first rehersal asked the MD whether he wanted to see me again, and then asked him how much this job pays and replies $100. that was about it, then until the last night i ask him about it and says that i’ll probably get a mailed cheque sometime, and u know the rest :-) Besides being only a 16 year old kid, its kinda hard to get some respect around here :-| The Man: Kristoff Lajoie The band: Seismic – www.xor.4t.com

Unfortunately it’s probably not worth the time and effort although I’d be tempted to pursue it a bit just out of principle. Start by writing down all the facts (dates and names of people spoken to, performance/rehearsal details, etc.) then find out who is actually responsible for payment – the University or the theatre company. Then send a polite but firm demand for payment laying out details of the performance, and who promised what, to this person and say that legal action will be taken unless payment is forthcoming within 14 days of the letter(don’t forget to date the letter). If you still get no joy, you’ll need to see a lawyer. The Law Society in your state probably provides a service similar to WA and SA where you can get a 20 minute session for very little cost, which they will probably waive on request anyway.
